These Terms and Conditions (the “Terms”) govern your access to and use of the website located at thebrickspizzeria.com (the “Site”) and any related online ordering, reservations, event inquiries, gift card purchases, and other services offered by The Bricks Pizzeria (“The Bricks,” “we,” “us,” or “our”). By accessing or using the Site or our services, you agree to be bound by these Terms. If you do not agree, do not use the Site or our services.

2) Eligibility and Use of the Site

You must be at least the age of majority in your state or province of residence to use the Site and our services. By using the Site, you represent that you have the legal capacity to enter into these Terms.

3) Changes to the Terms and the Site

We may update these Terms at any time. The updated version will be indicated by an updated effective date. Continued use of the Site or our services after changes becomes effective constitutes acceptance of the revised Terms. We may modify, suspend, or discontinue any part of the Site or services at any time without notice.

4) Accounts, Communications, and Electronic Notices

You may be able to create an account or submit information to place orders, make reservations, inquire about events, or purchase gift cards. You agree to provide accurate information and to maintain the security of your credentials.

By providing your email or mobile number, you consent to receive transactional and, where permitted by law, marketing communications. You can opt out of marketing emails using the unsubscribe link or by contacting us. For SMS, message and data rates may apply. Reply STOP to opt out and HELP for help. Consent is not a condition of purchase.

You consent to receive electronic communications and agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.

5) Online Ordering, Pricing, and Payments

Ordering and Availability

Menu items, descriptions, allergens, prices, fees, taxes, tips, and estimated preparation or delivery times are subject to change without notice. Availability can vary by time and date. Photographs are for illustration only.

Pricing and Taxes

Prices are listed in U.S. dollars and exclude applicable taxes and fees unless stated otherwise. You are responsible for all applicable taxes. Tips or gratuities may be suggested for convenience but are optional unless expressly stated for a specific service.

Payments and Processors

Payments may be processed by third-party providers. By submitting payment information, you authorize us and our processors to charge the total amount to your selected payment method. We do not store full payment card details on our systems. Orders may be canceled or refused in our discretion, including for suspected fraud or unauthorized activity.

6) Reservations, Waitlist, and Table Use

We may offer online reservations or a waitlist. Reservation details, party size limits, seating time limits, and grace periods may apply and will be communicated during booking. If your party does not arrive after a brief grace period, we may release your table to accommodate other guests. Please contact us if you are running late.

7) Events and Private Dining

We offer a private event space subject to availability and confirmation. Current standard rates and inclusions are:

  • Room Rental: Weekdays $125; Weekends (Friday/Saturday) $250

  • Service Charge: 25% service charge applies

  • Billing: One bill is preferred

Food Packages:

  • Appetizers & Pizza: $20 per person; Kids 5–9: $9. Includes Tapenade, Arancini, Cheese Bread, and 3 pizza selections of your choice.

  • Appetizers, Salads & Pizza: $25 per person; Kids 5–9: $9. Includes Tapenade, Arancini, Cheese Bread, 2 salad selections, and 4 pizza selections of your choice.

All event packages include soda, tea, and coffee. Menu selections may be subject to seasonal availability.

Booking, Deposits, and Changes
We may require a deposit or signed confirmation to secure your date. Final guest counts, menu selections, and payment schedules will be outlined in your event confirmation. Changes, cancellations, and refunds are handled according to the terms communicated at booking. Additional fees may apply for last-minute changes, damages, or special requests.

8) Gift Cards

Physical or electronic gift cards may be available through the Site or third-party providers. Gift cards are not reloadable, not for resale, and not redeemable for cash except as required by law. Lost or stolen cards will not be replaced except as required by law. Gift cards are typically usable for eligible purchases at The Bricks Pizzeria and are subject to any additional terms presented at purchase.

9) Promotions and “Pizza Deals”

Special offers, coupon codes, loyalty benefits, and pizza deals are subject to their specific terms, availability, and expiration dates. Promotions cannot be combined unless stated. One offer per order unless noted. We may modify or discontinue any promotion at any time.

10) Menu, Allergens, and Dietary Information

We prepare food in a kitchen that handles common allergens. We cannot guarantee that any item is free of allergens. Please inform your server of allergies or dietary needs. Ingredient lists and nutritional or allergen statements are provided for general information and may vary by season and supplier.

11) Alcohol Service

Alcoholic beverages are available for purchase to guests who are 21 or older with valid government-issued identification. We reserve the right to request identification and to refuse service where appropriate.

12) Third-Party Services and Links

The Site may link to or integrate with third-party platforms for ordering, reservations, payments, analytics, social media, gift cards, or delivery. We are not responsible for third-party content, policies, or practices. Your use of third-party services is governed by their terms and privacy policies.

13) Intellectual Property

All content on the Site, including text, graphics, logos, images, menus, and the design and arrangement thereof, is owned by or licensed to The Bricks and protected by intellectual property laws. You may not copy, reproduce, modify, distribute, display, or create derivative works from Site content without our prior written permission.

14) User Content and Feedback

If you submit reviews, photos, comments, or other content, you grant The Bricks a nonexclusive, worldwide, royalty-free license to use, reproduce, modify, publish, and display such content for marketing, promotional, and operational purposes. You represent that you own or have rights to the content you submit and that it does not infringe any third party’s rights or violate any law. We may remove content at our discretion.

15) Acceptable Use

You agree not to use the Site or services to:

  • break any law or regulation;

  • infringe intellectual property or privacy rights;

  • transmit malware, spam, or harmful code;

  • attempt to gain unauthorized access to any systems;

  • scrape or harvest data without permission; or

  • engage in any activity that disrupts or harms the Site or services.

16) Privacy

Your use of the Site is subject to our Privacy Policy, which explains how we collect, use, and share personal information. By using the Site, you consent to our data practices described in the Privacy Policy.

17) Disclaimer of Warranties

The Site and services are provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and noninfringement. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

18) Limitation of Liability

To the maximum extent permitted by law, The Bricks and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Site or services, even if we have been advised of the possibility of such damages. Our total liability for any claim arising out of or related to the Site or services will not exceed the greater of one hundred U.S. dollars ($100) or the amount you paid for the applicable order or service giving rise to the claim.

19) Indemnification

You agree to indemnify, defend, and hold harmless The Bricks and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising from your use of the Site or services, your violation of these Terms, or your violation of any law or third-party right.

20) Governing Law; Venue

These Terms are governed by the laws of the State of Michigan, without regard to conflict of laws principles. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Wayne County, Michigan, for all disputes not subject to arbitration.

21) Dispute Resolution and Arbitration

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at info@thebrickspizzeria.com. If we cannot resolve the dispute within 30 days, either party may commence binding arbitration administered by a reputable arbitration provider under its commercial rules. Arbitration will take place on an individual basis in Wayne County, Michigan, unless the parties agree otherwise, and may be conducted by telephone or written submissions as permitted.

Class Action and Jury Trial Waiver: You and The Bricks agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class or representative action. You and The Bricks waive any right to a jury trial.

Some jurisdictions do not allow mandatory arbitration or class action waivers. If a court determines that these provisions are unenforceable for a particular claim, then that claim will be decided by a court of competent jurisdiction, and the remainder of the provisions will remain in effect.

22) Termination

We may suspend or terminate your access to the Site or services at any time for any reason. Upon termination, your right to use the Site will cease immediately. Sections that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

23) Severability; Waiver

If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision will not be deemed a waiver of such right or provision.

24) Entire Agreement

These Terms, together with any policies or terms referenced herein, including our Privacy Policy and any event or promotion-specific terms, constitute the entire agreement between you and The Bricks regarding your use of the Site and services and supersede all prior or contemporaneous agreements on the subject.
